T&Cs for the Family Recipe Day Competition

 

Social media competition

  1. These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions and by participating, all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.

 

  1. The Promoter: Emmi UK Limited (“Emmi UK”), 111 Upper Richmond Road Putney, SW15 2TJ.

 

  1. Eligibility: This promotion is open to UK residents, aged 18 years or over at the date of entry, excluding employees of the Promoter and their immediate families, associated agents or anyone professionally connected with the draw.

 

  1. Promotional Period: The promotion will run from 00:00:01 BST on 22.04.2021 to 23:59:59 BST on 16.05.2021. Entries outside of this period will not be accepted.

 

  1. Entry Instructions and information:
    • Share a recipe of a family meal containing Onken Natural Set yogurt together with a picture of the meal or video of you making it using #OnkenLegendairy on Facebook or Instagram, by 11.59.59 BST on 16 May 2021.
    • This recipe could be one that has been handed down to you from previous generations, one you’ve significantly updated to make your own or a new one you have devised yourself but it must be your recipe (eg not one copied from a cookbook or the internet).
    • By entering, you confirm this recipe is your own recipe, not the intellectual property of somebody else, and that you have the right to send it to us.
    • Photos or videos should not contain:
    • third-party branded products;
    • in the case of videos, any audible music; or
    • the likeness of anyone else without their consent.
    • By entering, entrants grant Emmi UK an exclusive, perpetual, worldwide, royalty-free and irrevocable licence to use their entry (including photos, videos and the recipe itself) for promotional purposes including but not limited to social media, PR and website promotion and inclusion in the Onken Natural Set Family Recipe Day book, which will be hosted on the Onken website.
    • By entering, entrants agree that their personal details including name, address, date of birth, and social media handles may be processed by Emmi UK for the above promotional purposes, as well as the purposes of judging the competition, awarding prizes and contacting the winner and runners-up.

 

  1. You are able to enter as many times as you wish during the Promotional Period.

 

  1. Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.

 

  1. Invalid, misdirected or late entries will not be accepted. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

 

  1. Bulk entries, entries submitted via agents, third parties, organised groups or those automatically generated by computer will not be accepted but may still be charged. Entries received by any other means (e.g. post) will be rejected. Any person persistently trying to circumvent the entry process will be disqualified immediately.

 

  1. The Prizes: The winner’s prize is a place for one family (maximum four people in a family with at least one adult over 18) to join a video call cook-along with celebrity Marvin Humes (who will show the family how to cook a family recipe of his choosing) and a cooking set to the value of about £250. . The winner will be asked to provide the names of all other family members attending during the prize acceptance process. Verification may be required. The winner will share the cook-along session with one other winning family, chosen via a separate prize promotion. The private cook-along session will be hosted via video call or another suitable video platform in June 2021 for a duration of approx. 1-2 hours. The winner and participating members of their family must make themselves available at the date and time advised by the Promoter and ensure they have a suitable kitchen with a hob and an oven in which to join the cook-along and suitable technology to join in eg laptop, Wi-Fi and camera. The prize winner and participating members of their family must not photograph or film the prize session (other than as necessary to take part in the cook-along) or share photography, videography or other details of the session on social media or other public channels including attendance at the event at any stage. The prize winner and participating members of their family must also adhere to any health and safety measures requested by the Promoter or its representatives, including but not limited to COVID safe protocols and risk assessments. The runners-up will each win an Onken merchandise package including an apron and recipe folder, worth around £50 and Onken vouchers to the value of around £35, which will be sent to them by postal mail.

 

  1. Selection Process: One winner will be selected from a longlist during the week of 19th May 2021 by a panel including a representative from Onken and its agencies, an independent adjudicator and a celebrity judge. Five additional runners-up will also be chosen. The winner and runners-up will be chosen against criteria of: use of Onken Natural Set yogurt, creativity / originality of recipe / how delicious it looks/tastes. The overall winner will be chosen based on the highest score out of 40 on the above criteria. The winner and runners-up will be notified during w/c 19 May 2021. The runner-up prizes will be provided by postal mail as soon as possible after w/c 19 May 2021.

 

  1. Winner selection is final and binding and no correspondence will be entered into, except with the winners.

 

  1. Prize Redemption: The prize winner will be contacted via DM on the social media platform used to enter the promotion and asked to confirm name and address within 3 working days. A representative of the Promoter will liaise with the prize winner to provide details of how their prize will be fulfilled including providing them with details of how to join the cookalong and providing a delivery of the ingredients they will need. In the event that the Promoter is unable to contact a winner within 3 days, the Promoter reserves the right to select an alternative winner from the runners-up , with the originally selected winner forfeiting their right to the prize. The runners-up will be contacted via DM on the social media platform used to enter the promotion and asked to confirm name and address within 3 working days. A representative of the Promoter will liaise with the runners-up to provide details of how their prize will be fulfilled. In the event that the Promoter is unable to contact a runner-up within 3 days, the Promoter reserves the right to select an alternative runner-up from the longlist, with the originally selected runner-up forfeiting their right to the prize.

 

  1. The Prize is as stated, is not for exchange and no other prize alternatives are available. Unless otherwise agreed in writing by the Promoter, a prize will only be awarded directly to the entrant. A maximum of one prize can be won per entrant. Should the prize outlined above not be able to be provided for reasons outside of the Promoter’s control, the Promoter will endeavour to provide a suitable alternative prize, the alternative to be decided at the sole discretion of the Promoter.

 

  1. General: The Promoter is not responsible for any entries/claims which fail to be registered or are delayed for any technical or other reason whatsoever. If fulfilment or any element of this promotion is delayed or affected due to the continuing Covid-19 pandemic and resulting Government restrictions, all entrants affected will be contacted by the Promoter and kept updated of any unavoidable changes to the promotion dates, fulfilment dates or prize.

 

  1. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and acceptance of the prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

 

  1. The winner’s and runners’-up contact details will be retained for 30 days after the conclusion of the Promotional Period to allow the Promoter to notify. The winner and runners-up can request for their phone number and address to be deleted before the expiry of this period by writing to ONKEN Details Deletion, Emmi UK, 111 Upper Richmond Road Putney, SW15 2TJ although the Promoter cannot be held responsible if such request means that it is unable to complete delivery of the prize.
  2. Except where a prize winner and runner-up has notified the Promoter that they do not want their details shared, the prize winner’s details (abbreviated names and counties of residence only) will be available for a period of 30 days by sending a stamped addressed envelope to ONKEN Details Deletion, Emmi UK, 111 Upper Richmond Road Putney, SW15 2TJ between 16.05.2021 – 16.06.2021. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

 

  1. The prize winners may be asked to take part in reasonable publicity in connection with the promotion with no recompense, during the 30-day period referenced in Condition 18 when their details are being retained, except where a prize winner has requested for their details not to be publicised. .

 

  1. The Promoter reserves the right to verify all entries including but not limited to asking for a winner’s or runner’s-up identity details along with those of their family and proof of purchase (which they must provide within 14 days but which will not be retained following verification by the Promoter) and to refuse to award the prize or withdraw the prize entitlement and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of the entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.

 

  1. LIMITATION OF LIABILITY Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

 

  1. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.

 

  1. The Promoter is not responsible in the event that the winner or runners-up fail to receive their notification for any reason.

 

  1. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

 

  1. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, the Promoter reserves the right to suspend the promotion or amend these terms and conditions, at any stage, with no liability to any entrants or third parties, but will always endeavour to minimise the effect in order to avoid undue disappointment.

 

  1. This promotion and these terms and conditions shall be governed by and construed in accordance with the law of England and Wales and the parties to any dispute or action shall submit to the exclusive jurisdiction of the English courts unless you live in another part of the UK, in which case your local courts will have jurisdiction.
  2. Personal data in photos or videos may be used for promotional purposes as set out above. Any other personal details provided by entrants when participating in the promotion will be used for administrative purposes only and will be deleted once the prize has been allocated to the winner. Save as set out above the winner’s and runners’-up details will be held and subsequently deleted in accordance with Condition 18.  Other than photos and videos of winning entrants, entrants’ personal details will at all times be kept confidential, and all personal data will be kept in accordance with applicable data protection legislation.
